Hi,
Our neighbors brought to our attention that the wall dividing our properties
had recently begun to crumble (we hadn't noticed with all the snow!), and
that some earth had spilled onto their side from ours (our property is
slightly above theirs).
Does anyone know what the RI law/regulation is regarding the cost for
repairing a wall in this type of situation? I managed to locate an RI
general law concerning "fences" but I'm not sure if this the same thing:
*§ 34-10-15 Complaint of neglect to maintain fence.*
>
> (b) Whenever any vegetation overgrows and damages a partition fence, the
> proprietor, possessor or owner of the land from which the vegetation
> originates shall be liable for the removal of all of the overgrown
> vegetation and the necessary repairs to the partition fence caused by the
> overgrown vegetation.

This would seem to suggest that we're responsible for the cost of the repair
(which is fine--we just want to know what the law says).
Does anyone have experience/knowledge of this? Can anyone recommend a
landscaper/contractor who handles this type of thing?
Thanks in advance.
