After six months of attempts to seek a reasonable accommodation with
the landlord, 15 residents of Fourth St have appealed the issuance of
a Building Permit for construction of a bicycle shop at 212 Fourth
St. The appeal requires that a Stop Work order be issued by the
Department of Inspection & Standards, and the order was issued last Friday.
It's critical for everyone to know that the bike shop (Caster's) is
not the issue. The building owner (an entity of the Paolino
organization) is attempting to illegally change a nonconforming use
of a residentially zoned building without seeking a variance from the
Zoning Board and to illegally retain the right to reestablish
long-abandoned use of the building for auto repair. As neighbors, we
refuse to tolerate the illegal return of the noise, smell and danger
we endured when the repair shop was open.
