David,
TWO members of the City Planning Commission argued that the current
proposal WAS NOT compliant with Providence's Comprehensive Plan. Compliance
with the Comprehensive plan *is a requirement of the law.*
The quote you cite from Tom Moses, the applicant's lawyer, is his venting
emotional steam-- The ProJo writer goes on to say that he was "seething"
after the hearing.
The law requires compliance with the Comprehensive Plan. Two members of the
committee did not find the proposal to be complaint with the Comprehensive
Plan and one questioned whether a subdivision really was NOT a land
development project, as the applicant's lawyer, Tom Moses, argued.
While there was a large public turnout, the members who voted not to
approve had strong well-reasoned arguments not to do so, which I have
outlined above.
