On the back border of my property there is a fence that is mine (via previous owner) connected to the back wall of a garage which is my back neighbors'. The garage wall is a little further back (from my perspective) than the fence, so the fence has a little angled section that connects the two. The neighbors are rebuilding the garage and want access and rights to the strip of their land -- ca. 5 ft. wide x 20 in. deep -- that is behind their garage and functionally in my backyard, and which I am using as garden space. (It never occurred to me that I didn't own it.) They say the property line is the fence line, though nobody really knows and the whole disputed "parcel" is so ridiculously small there is no way I am going to get a survey. They say they need access from my side to take down the back wall and rebuild the garage. I don't want their work crew using my yard for access, and I also don't want them to take down the fence to get access, and most of all I am worried about my plants getting trampled. <BR>

The whole thing seems so silly, yet so complicated! Does anyone know what my rights are to this bit of land that is functionally mine and legally theirs? They are acting as if I have no rights at all, and I think this is not the case. I tried reading the property laws, and gave up. I don't want to occupy the listserve with my personal stuff, so please reply off list unless you think its pertinent to all. Thanks much. Ellen on Mayflower St.<BR>
